Massachusetts law allows a wrongful death claim whenever a death is caused by:

  • Negligence
  • A willful, wanton or reckless act that would have given the victim a personal injury claim
  • A breach of warranty injury that leads to death

A wrongful death case is brought by the executor or administrator of the estate for the benefit of:

  • The surviving spouse
  • The surviving spouse and a surviving child shared 50/50
  • The spouse and all children, with 1/3 going to the spouse and the remaining 2/3 divided among the children
  • The deceased’s next of kin if there is no surviving spouse or children

The plaintiff in a wrongful death action can recover for the fair monetary value of the deceased. This includes costs such as:

  • The loss of the person’s reasonably expected net income, services, protection, care, assistance, society, companionship, comfort, guidance, counsel and advice
  • Reasonable funeral and burial expenses
  • Punitive damages of at least $5,000 if the actions causing death were malicious, willful, wanton or reckless, or amounted to gross negligence
  • Conscious pain and suffering (this amount is paid to the estate and distributed accordingly)
